“The ordaining of laws in favor of one part of the nation, to the prejudice and oppression of another, is certainly the most erroneous and mistaken policy. The collective statement of the thirteen American states, When it becomes necessary, in the course of human events, for one people to sever the political ties that have bound them to another and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect for mankind's opinions demands that they should declare the reasons that motivate the separation.

Prudence, after all, will suggest that long-established governments shouldn't be altered for trivial reasons. However, history has shown that people are more likely to put up with injustices while they still exist than to change their ways and institute new ones. However, when a lengthy history of wrongdoings and usurpations pursuing consistently the same goal indicates a desire to subject them to total despotism, it is their right and responsibility to overthrow such a government and to install new Guards for their continued security. — Such has been their patient suffering, and such is the current constraint forcing them to change their prior systems of government.

What is the Mosaic Code of the Israelites? How did it influence the foundation of the U.S. legal system?

Answers

Answer:

The Mosaic Code is a set of laws found in the Hebrew Bible. It is also known as the Law of Moses or the Pentateuch. The Code includes laws governing many aspects of life, including morality, family life, criminal law, and civil law. The Code has been influential in the development of the U.S. legal system, particularly in the areas of property law and contract law, because, like the Code, the U.S. legal system is based on common law which, in turn, is based on court decisions.

1. Imagine that you are responsible for filling roles for a mock criminal trial. What parts would need to be represented? What types of responsibilities would each position have? Make a list.

2. During the pre-trial phase, witnesses are summoned to the courtroom in which they will testify to the facts of a case. During the trial, both fact witnesses and expert witnesses give testimony. Write a response comparing and contrasting what happens with an expert witness versus a fact witness.

3. The Constitution grants all US citizens the right to bail, even when they are facing serious crimes such as murder. Do you agree with this? Why or why not?

4. In most states, the post-trial phase requires judges to sentence the convicted using a sentencing table. This means that they cannot go over or under the recommended sentence for that particular crime. Do you think the law should dictate what the sentence for a particular crime should be, or should this be solely at the discretion of the judge? Explain.

5. Serving a defendant or witness with court documents is an important part of the pre-trial process. Do you think service should always happen in person or is dropping off the paperwork okay? What should happen to those who refuse to receive a summons? Defend your stance.

Please help me out!!

Answers

Answer:

1.  The parts that would need to be represented are Pretrial Motions, Jury selection, Opening statements, Prosecution's case. The responsibilities for pretrial motions is to Help ensure that defendants released to the community before trial commit no crime while awaiting trial and return to court as required. Jury selection or "jury"  they look at evidence and determine if someone should even be charged with crime in the first place.

2. Fact witnesses provide details about specific circumstances in a case, expert witnesses provide insight in a case by sharing their expert knowledge of a subject based on their training and experience.

3. I personally don't agree with it, it takes away the justice available for the victim and gives the murderer another chance to do the crime again if they are really delusional. For some, it's okay to bail if the crime wasn't too serious. But for high crimes I believe they should not be an option for bail. For example the murderer of your mother had a right to bail, so he requested a bail, or was offered and he had the money to do so and got away with his crime, its unfair.

4. The law should not dictate the sentence for a particular crime, it makes much more sense solely for the judge to make that decision in a certain sense for a crime. A judge interprets the law, imposing sentences, issuing subpoenas etc. It would be better for a judge to make the decision.

5. Service should always happen in person to get a better understanding of them just reading them off a piece of paper, dropping off paper is okay too and it would be a faster process for the defendant/witness to access the documents. In person it makes much more sense.  If a person refuses a summons, what I believe would happen to them according to my notes is that in most cases they are legally allowed to, but it doesn't stop them from having a lawsuit against them. A judge is most likely also to have a bench warrant for their arrest.

The amendment process in the US requires a cooperative exertion among Congress and the states. Subsequently, choice (A) is exact.

To propose a revision, either a 66% larger part vote in both the Place of Delegates and the Senate or a public show called by 66% of the state governing bodies is vital. When proposed, the revision should be endorsed, requiring endorsement by three-fourths of the state assemblies or by shows in three-fourths of the states.

This process guarantees that both the bureaucratic and state legislatures are associated with forming the Constitution. It accentuates the significance of collaboration and coordination among Congress and the states to correct the essential tradition that must be adhered to.

Thusly, choice (A) is precise.

Examine the history of labor unions and answer the question "Are labor unions good for business?"Answer in 500 words

Answers

Answer:

Businesses and labor unions both aim to profit from their operations. I believe that the best way for business and labor to accomplish their objectives is through mutual concessions that result in a settlement that both parties deem just. Budget reductions and efforts to identify a solution that would be advantageous to both business and labor could be examples of these compromises. By putting aside their own interests and making sure they don't do anything that would harm the other, business and labor could reach a compromise. Having an advantage over one or the other, though, does nothing but cause more issues. Both businesses and labor unions suffer when they act in their own self-interest without considering what the other might benefit from. This has the exact opposite effect—it makes neither group look better than the other in the end. Businesses may use the additional 20% to support labor unions or the business, which would subsequently benefit the employees, if labor unions agreed to a compromise of splitting the cost of fringe benefits 50/50. Negative circumstances like sit-ins or strikes only result if people don't cooperate and try to find a solution. However, as a result of government regulations safeguarding American workers, incidents like that have decreased. Similar to how unions are starting to decline as a result of government policies. Government acts as a sort of mediator between industry and labor. Without these laws defending business and labor, there would be a rise in labor unions and more stringent, discriminatory regulations for corporations. That was demonstrated by time in the 1800s during the Industrial Revolution, when certain rules were nonexistent. For instance, robber barons or employers would exploit people by paying outrageously unfair wages or putting them in hazardous conditions at work. But since then, both the business and labor union movements in America have advanced significantly.
